In Anthony Burgess’ The Wanting Seed, the story starts off, in what is known to the main character, Tristram, as the Pelphase. Tristram is a history teacher and knows mostly all there is to know about history. According to Tristram, governments go through three phases: the Pelphase, the Interphase, and the Gusphase. Tristram believes that like almost everything else, government is cyclical. The Pelphase is a time in the government and society where the people are working to better themselves, their surroundings and their country. The people don’t just work for themselves; they work together. Overpopulation has always been a problem in the futuristic London that Burgess portrays. God has become a myth even though some still practice their religion. God has turned into some sort of Santa Clause because everyone is working to better the problems that they and the government are having. The government suggests that homosexuality could help the population troubles, but they don’t enforce it or make it law. People have the choice to have children or be homosexual. The government hands out rations of food every week because the crops aren’t growing and overpopulation is so prevalent. The rations are just enough to keep the people full and content. When the government realizes that nothing is working out and the crops still wont grow and overpopulation is still a giant problem, they give up the current ways and move on to new ways of governing. This brings the Interphase along. The Interphase is black and white compared to the Pelphase. It is a transition phase where things must be broken in order to fix them. When the government realized that giving people the choice to have children or be homosexual isn’t working in everyone’s favor and the crops are still aren’t growing, they made it mandatory to either be gay or have only one child and in addition to that the food rations have gotten smaller. Police (Greyboys) walked the beat in large groups looking for people that were breaking laws or people that weren’t. Taking them to jail for nothing was fine with the Greyboys. Innocent people were thrown in jail and kept in jail just by being in the wrong place at the wrong time. With all of the growing animosity towards the Greyboys and the government, people start to question and revolt. Nobody wants to go hungry; the straights don’t want to go gay; the families don’t want to break up. The Interphase didn’t last too long because of how badly the citizens felt about it. People were rising against the government and demanding their rights back. The government couldn’t take the pressure so they just ended up doing nothing. They literally did nothing. They left it up the people. With that decision came the Gusphase. The Gusphase was a wild and crazy time. People were going crazy in the streets, killing and looting. The government had no control over anything anymore. Hungry groups of people started attacking and cooking up Greyboys. They were creating exclusive cannibalistic dining clubs and taking part in intense orgies. The government lost so much of the control it once had, all of the prisons were emptied and the prisoners set free. With so much chaos going on, people were forced to fend for themselves and it became survival of the fittest. During all of the madness, priests and bishops were aloud to preach the word of their God again and that is what people held on to in this time of madness. The Gusphase, just like the Interphase, didn’t last long. The government eventually regained control of the population and things were back to the way they started, Pelphase. In the Pelphase after the horrible Gusphase, things were different than before. People were now aloud to have children and homosexuality wasn’t pressured upon the people. On the surface, it seemed as if the government has learned from their mistakes but under the surface things have taken a very deadly turn. The army had most of the control in the government now. The army went town to town tricking people into joining the army. After the people went through long and rigorous training they were sent off to the front lines in western Ireland. They weren’t fighting the Irish however; they were fighting other British men and women. The government set up elaborate shows to pretend that there was a war and when it came down to the actual battle the two sides of British would clash in a bloody death match. At the end of the fight, officers from the army, who were in on the whole scheme, executed the survivors so know one would find out about their evil idea of population control. Thanks to Tristram’s smarts and instincts, he was able to survive. He made his way back to the army headquarters and told them that he knew the whole plot. They didn’t pay him any mind, gave him his discharge check, and sent him on his way. He ended up going back to where he started before all of the crazy times London experienced in the past couple of years. He landed a job as a war history teacher and bought a new flat with his discharge money. After he was settled he found Beatrice-Joanna and his twin sons. Things finally came full circle for Tristram. In may ways, Tristram’s journey was a lot like the phases that the government went through. He had endured the brunt of each phase. He experienced the worst that each phase had to offer a human being. He survived and lived happily again.

I Had a Job I Liked Once by Guy Vanderhaeghe Essay Guy Vanderhaegh takes us back a few decades in the retelling of a court case in small town, Saskatchewan in the play, â€Å"I Had a Job I liked. Once. † Using elements of style, staging and developing characters throughout the play Vanderhaegh portrays to the audience the theme of the biases and prejudices that come with living in a small town. The story is set in small town Saskatchewan in a police station office, on the night of August of 1957. Corporal Heasman has brought in Les Grant on the account of accused rape Tracy Tolbertson, and the play follows the questioning of Sergeant Finestad to Les, who retells his involvement with Tracy, the daughter of Mr. Tolbertson, the local crown attorney. The story has many sub conflicts; the tension between Finestad and Tolbertson being a main one. Tolbertson wants his daughter’s accused rapist behind bars, but Finestad wants to get the whole story instead of just listening to Tolbertson. Then there is the conflict of Finestad with himself; for years he has followed the law and stuck to the book, but in this case he is having a hard time sticking to the black and white because he feels that there is more to the story. All these sub conflicts underlie to the main conflict of the prejudices and biases that come from living in a small town, and the difficulties that come with dealing with that. These conflicts all lead up to the climax where Finestand goes against Tolbertson and against the prejudices of the town and lets Les Grant go, without charging him. Vanderhaegh does a very good job of developing the characters in this play. We are first introduced to Sergeant Finestad who has a very strong character-he likes being charged and doesn’t do well with being told what to do. Finestad undergoes a very big character change through the course of this play. At the beginning, Finestad is very strict to the law, strict to the rules. As he says to Heasman before Les is brought in to be questioned, â€Å"Nothing about police work is personal. We follow the law, Tom. We’re the keepers of the rules. If we don’t keep them, what right do we have to enforce them? † This comes after he writes on the chalk board in big bold letters â€Å"NOT PERSONAL†. Through questioning Les Grant and learning his story, we see him change at the end where he lets Les go, not charging him and saying, â€Å"something broke down tonight, Tom. Either the book, or me. † He realized that he couldn’t charge Les just based on what it says in the book. The other character who undergoes change in the story is Les. Les comes from a very rough family, and has had some challenges throughout his life, but he has stayed a good, hardworking kid. He now works at the town swimming pool in the pump room, which is where he is changed. At the pool Les is bullied very badly- every day when he gets to work there is something new written about him or his mother on the bathroom walls, which he has to clean up. He puts up with this for so long until he finally can’t do it anymore and snaps, which is when he allegedly raped Tracy. Les is then judged because of his family background, and almost found guilty just based on the prejudices against him. There are other characters that help to contribute to the conflict as well. Corporal Heasman who works with Finestad is constantly against him, wanting Les to be charged to make Mr. Tolbertson happy. Mr. Tolbertson, as Finestad describes him, â€Å"likes to win, so the rules get ignored or ben. The law’s a game. † He doesn’t bother with protocol, but is just used to getting what he wants, in this case being Les being charged. He is a hard nut who always gets his way and orders everyone around, especially his wife and Tracy. Because of this, Tracy rebels and brings out her anger making other people feel bad, such as Les Grant. All these characters come together into forming the main conflict. Guy Vanderhaeghe broaches a theme that can be very relatable to people growing up in small towns. After Finestad releases Les Grant, he explains to Heasman the reason. He recalls a poem from his grade three teacher that has the lines â€Å"Tyger! Tyger! Burning bright/In the forests of the night. † He always asks himself, â€Å"Who made the tiger? Who made the tiger? † He then goes on to say, â€Å"Who made Les Grant? They did. And who made that girl? More of the same. Poor, sorry, fucked up tigers. And you and me-we’re supposed to play tiger tamer. After they’ve used their teeth. I might have been up to the game-once, but all of a sudden it seems too complicated for rules-for me. † This is where the main theme of small town prejudices is revealed, and how there’s more to people that what meets the eye. Society judges people based on their first impressions of what they see and what they’ve heard about them. The question â€Å"Who made the tiger? † refers to the events and families in people’s past that shape who that young person becomes. Tracy’s dad was very strict and hard on her, which makes her rebel, leading her to writing the cruel things about Les on the wall. Les has had to deal with his rough family life growing up which automatically causes people to judge him. Heasman describes them as a â€Å"Bad bunch, the Grants. † Les has also been bullied for such a long time that it causes him to act out. He is good kid, but all these outside influences came into making him make a bad decision. As he explained to Finestad, â€Å"Taking it from them for as long as I remember, that gave me the right. † He believed that he had the right to do that to Tracy because he has had so many things happen to him in the past. This play deals with the prejudices society has against people and how that shapes them into who they are. Guy Vanderhaegh’s use of styling really emphasizes many things in the play, whether it be through the use of different language, symbolism or repetition. Finestad’s injured back is one symbol of his relationship with Les. When Finestad hurts his back, he asks for Les to help him and says, â€Å"Don’t let them see me like this. Please don’t give me away. † He is humiliated and Les helps him, keeping his promise. At the end of the story, the tables are turned and Les is now the one who needs help. Les is asking Finestad to not lay a charge. He says, â€Å"Don’t’ give me away to them. That’s what you asked when your back went out. That’s what you asked me. † His back symbolizes the debt he owed to Les. The Tiger in Finestad’s poem also symbolizes Les Grant and Tracy Tolbertson, who had many things contributing into making who they are and resulting in the actions they did. Vanderhaegh also uses Tolbertson’s appearances as a way to contribute to the rising action of the play, leading right up to the climax. At first Tolbertson is just mentioned when Heasman and Finestad are talking about them, then he calls and Finestad ignores him, and finally he shows up trying to threaten Finestad. In all three â€Å"appearances†, Finestad put Mr. Tolbertson down leading right up to the climax where he completely opposes Mr. Tolbertson and does not charge Les. The repetition of acknowledging the statute book also emphasizes Finestad’s character change. He went from following it’s  every word to forgetting about it and going against it at the end. The staging also helps in contributing to creating the mood of the play. The whole play takes place in the one office at the police station with no scene change. This set is very basic, which makes you focus on the characters and their actions instead of their surroundings. The lighting used helps to create the atmosphere for the memories Les has, such as it creating a â€Å"lattice-work effect to suggest a grill† at the pool, or the dimming of the lights suggesting a soft summer night on the day Les picks up Tracy. Instead of scene changes, characters enter and exit the scene giving the impression of a new location. Even in memories, Tracy actually enters the office as Les is describing the memory so as to give the audience a better understanding of what happened. The use of different sounds, such as splashing at a swimming pool or music in a car helps create the atmosphere as well. At the end of scenes, the characters do not leave, rather the lights blackout. The scene is different, but they are still in the same place. This gives you a sense of mood change to the scene. Finestad never leaves the office until the very end of the play, where he turns the office light off, walks out and the curtain comes down, giving you the sense of finality. Many things have to come together in a play to get the main message across. With Guy Vanderhaegh’s effective use of styling, staging and character building he efficiently gets across to the audience the idea that with small towns come prejudices and biases, and that before making judgments you need to understand a person’s background and circumstances to get the whole story. â€Å"I Had a Job I Liked. Once. † is an interesting play with a good message to take home.

Voluntary Disclosure of Income Scheme Analysis HISTORY OF ECONOMIC THEORY PAPER PHILOSOPHISING A LAW: VOLUNTARY TAX DISCLOSURE Joanna Thomas A. THE LAW The Voluntary Disclosure of Income Scheme was launched by on the 18th of June, 1997. It continues for six months until the 31st of December, 1997. It was launched by The Central Board of Direct Taxes. Its aim was to unearth disclosed income, to provide income tax and wealth tax defaulters an opportunity to disclose their income at the prevailing tax rates, while under the umbrella protection of immunity from all major laws relating to economic offences, and to mobilise resources and channel funds into priority sector of the economy. Those opting for the VDIS would be granted immunity from prosecution under the Foreign Exchange Regulation Act, 1973, the Income Tax Act, 1961, the Wealth Tax Act, 1957, and the Companies Act, 1956.1 In the six months of its existence, 4,75,477 people disclosed their assets and incomes under VDIS. This garnered a revenue of 33,697.32 crore rupees to the Indian Finance Ministry on which Rs. 9,729.02 crore were paid as tax. While some saw the scheme as a success that boosted the government’s coffers, others were outraged. A Public Interest Litigation (PIL) was filed in the Supreme Court under the argument that schemes like VDIS penalised honest tax payers while at the same time, it encouraged tax evaders. A. 1. FEATURES The salient fetters of the scheme include: 1. The declarant would have to file a declaration before the Honourable Commissioner of Income Tax. The Commissioner would then grant him a certificate, setting forth the particulars of the voluntarily disclosed income and the amount of income tax paid in respect of the same. This provided the declarant immunity from prosecution under the Income Tax, 1961. A person may make a declaration in respect of any income chargeable to tax for any assessment year prior to the assessment year 1998-99: for which he has not filed a return under section 139 of the Income Tax Act. for which he has failed to disclose in a return of income furnished by him under the IT Act before the date of commencement of the Act. which has escaped assessment in terms of section 147 as it stood prior to 1.4.1989 and thereafter. 2. The scheme covered all persons, both corporate and non-corporate. The tax payable on the disclosed income was 30% for individuals and 35% for all other declarants, i.e., corporates and firms. The tax on the voluntarily disclosed income or wealth would have to be paid before making the declaration, and proof of such payment was to be attached along with the declaration. 3. Those who opted for the VDIS would be granted immunity from prosecution under the Foreign Exchange Regulation Act, 1973, the Income Tax Act, 1961, the Wealth Tax Act, 1957, and the Companies Act, 1956. 4. A person in whose case a search under section 132 of the Income Tax Act has been initiated or where books of account, other documents or other assets have been requisitioned under section 132A will not be entitled to make a declaration in respect of the previous year in which the search was made or any earlier previous year. B. THE PHILOSOPHICAL WORKINGS P. Chidambaram, the mastermind behind the VDIS, claimed that broadening the tax-net through VDIS was a more goal than how much the scheme could net. Of the 4,66,031 respondents from VDIS, most were part of the 12 million who formed the tax-net. Most of these 12 million were grossly under-reporting their revenues and with this amnesty they were able to change their black money to white money at a much lower rate. Chidambaram ended up protecting the right of tax evaders. This goes against the philosophy of equitous taxation. The amnesty scheme hampered the government’s regular tax collection as tax-evaders, specially businessmen, non-salaried professionals who could opt out of the tax net, found it cheaper to declare their incomes with the lower tax rates of the amnesty schemes. In addition to that, as this scheme was anticipated in advance, the tax evaders were able to dodge paying taxes — which could be seen by a drop in revenue collections — before the scheme actually arrived. This was what happened with the VDIS. Evaders were aware from March that the tax pardon was on its way and hence, personal income tax collections in the first seven months of the current fiscal year recorded a significant drop. A post-VDIS drop also occurred, as has been seen in the case of earlier amnesty schemes. Therefore, despite the ‘record haul’, the government emerges as a net loser in this scheme as the VDIS hampered long-term tax collections that in effect proved the government’s crusade against corruption to be a sham.2 Actually, pardons provided at regular intervals may shrink the tax base instead of expanding it, as Chidambaram expected. It encourages more tax-dodging. Before the 80’s pardons were witnessed at the rate of once every twelve years. However in the 1990’s, amnesties were witnessed six times in eight years. Hence, Chidambaram’s threat that the VDIS would be the last opportunity for evaders to come clean, didn’t hold much ground. Another claim of Chidambaram was that an objective of the VDIS was to mop up black money. But how much can an amnesty work towards absolving an evader? According to a study done by NIPFP in the 1980’s, black money in India was valued at 18-21% of the GNP. Other independent assessments, however, estimated the value to actually be around 50%. Even assuming a low rate of 10%, in the 1990’s, with GNP at 12.6 million crore rupees, the black money in the country can be estimated to be 1.26 million crore rupees. When you compare this to the amount disclosed through VDIS, it barely accounts for 2.5%. And the VDIS was supposed to to account for black money of years past! It can be said that the VDIS provided just the right loopholes that tax evaders were looking for. It provided immunity from various laws and also gave evaders legitimacy for ownership of single units of property in overseas areas and investments in bonds, debentures, shares, fixed deposits etc. Further, declarations under VDIS could not be used as evidence against the declarant in those proceedings that involve penalty imposition or litigations under acts such as IT Act, Wealth Tax Act or Companies Act. Take the example of the son of a very senior Congress leader from Andhra Pradesh who declared Rs.700 crores under the VDIS. The massive loot was amassed over the years from cuts and kick-backs. By paying Rs.200 crores he can now pocket the rest of the booty which now becomes white and rest assured that he can safely skirt all legal probes in the future.2 Declarations were made even minors, 2472 declarations to be exact, whose income were joint with that of their parents. This was permitted by the CBDT clarification which was actually inconsistent with the stated law. A test check revealed that these minors declared undisclosed income on dates prior to their birth! Loopholes could also be found in the declaration of jewellery or silver articles. Initially, the clarification was to assess bullion and jewellery purchased prior to 1 April 1987 at the rates prevailing as on that date. However, this clause was amended later in November that stated that bullion and jewellery should be assessed at the rates that were prevailing on the date of acquisition or purchase, only if a credible proof of purchase or acquisition could be provided. Unfortunately, credible proof was left unexplained and undefined. This loophole provided the most used channel for money laundering under the scheme. Due to this loophole, tonnes of silver was shown in backdated purchases when prices were much lower than the current prices thus reducing the effective rate of taxation. Another negative effect was that silverware dealers began providing fake receipts to anyone who needed one. In this way, the VDIS provided a lucrative opportunity to create legalised assets by converting undisclosed assets with a much lower effective tax rate. This could be the reason why land, gold and jewelry declarations was far more than that of cash. But this, however, could also be explained with the fact that black money is generally not kept in cash. Another failure of the Scheme was to lay down valuation requirement for real estate properties. This gap was taken unfair advantage of by the declarants who were able to declared their assets at insanely high values and also managed to protect themselves with the immunity provisions of the VDIS. A property that was purchased earlier in part with black money and shown in registration records at the value equaling the white money involved, could now be declared at its real price i.e. the black and the white money combined. Today, with an appreciation in the value of the property, the declarant could sell and purchase a bigger property with the newly acquired white money. C. THE VERDICT The VDIS was drafted with a number of gaps. This was, in turn, compounded by CBDT circulars, clarifications and press briefings that completely benefitted the declarants, i.e., the tax evaders. A number of gaps was left in procedural matters in the implementation of the Scheme. This impacted revenue realisation. The department was deprived of legitimate revenues due to the undervaluation of jewellery and bullion. In addition to this, the capital loss that arose from jewellery and bullion declarations contributed to the wiping out of the immediate revenue generated from their disclosures in a few years time. The department had also not instituted any special mechanism that would monitor the declarants in post-VDIS period. The government had recently announced an amnesty scheme for service tax offenders. This was the Service Tax Voluntary Compliance Encouragement Scheme. The scheme was in effect till December 2013 and is believed to have fetched around 6000 crore rupees to the government. Finance Minister Chidambaram said the government will not be able to announce any more amnesty schemes for the next 20 years. This was due to various factors which includes curbs imposed by the Supreme Court. Such schemes cannot be announced every year. There is a Supreme Court judgement on VDIS which actually ties up our hands in announcing a scheme on the lines of VDIS, Chidambaram was quoted as saying by the PTI. In conclusion, there is little doubt about which section of society actually benefits from these kinds of amnesty schemes. For honest tax payers, i.e., mainly the salaried class who pay tax at source at higher rates, this is a direct violation of equal tax for equal income. It also shows the government’s impotence in ensuring compliance by the bourgeoisie to come clean. In the mean time, the ruling class eagerly waits for the next amnesty, as he/she knows fully well that amnesties are means to not only for exonerate oneself from crimes but also provides ample opportunities for one to commit further crimes.
